The following terms and conditions apply to customers of Cable Bay Vineyards LTD, New Zealand. By purchasing products via the Cable Bay Vineyards website and by joining the Cable Bay Membership Programme, you agree to, and are bound by, all the terms and conditions in these Terms of Service.
We reserve the right to modify our Terms and Conditions at any time.
1.PURCHASING
By using our Website, you agree to these Terms and Conditions, and all the terms, conditions, disclaimers and limitations that appear or are made available to you on our site.
If purchasing wine or other products on this website you agree to the following:
- 1.2 You authorize Cable Bay Vineyards to charge your credit card in NZD for the amounts appropriate to your purchase, as defined by the price listed in your cart, inclusive of taxes, fees and cost of shipping.
- 1.3 Prices are subject to annual review in May and take effect 1st of July.
- 1.4 If purchasing wine, you agree that you are at least 18 years of age. If that is not true, and we are held liable for any reason, you agree to indemnify us and/or reimburse us and be responsible for all costs, expenses, legal fees and damages we suffer or incur.
- 1.5 When you purchase wine from Cable Bay Vineyards, deliveries will be attempted three times to the address that you provide. Should the three attempts fail, you acknowledge and agree to a $20 re-dispatch fee to cover the costs charged to us for the failed delivery as well as the cost of re-dispatching your wine a second time.
- 1.6 Orders are accepted at our sole discretion and we maintain the right to decline orders without giving an explanation.
2. PRIVACY POLICY
Cable Bay Vineyards respects and honours the privacy of its customers and membership holders. The company doesn’t sell or rent personal information to any third parties. The provided information, from those who elect to join the e-mail newsletter mailing list, will be added to our customer database to receive upcoming correspondence. Those who do not elect to receive the newsletter will not be added to any database apart from what is necessary to provide customer service for each of your orders or quarterly shipments Any personal information that Cable Bay Vineyards collects from its customers is retained in a private database and may be referenced from time to time to help optimize the functionality of the website, online shop and other related areas connected to customer experience.
There are several situations when you can have us delete your personal data, this includes (but is not limited to):
- We no longer need to keep your personal data;
- You have withdrawn your consent to us using your personal data (and we do not have any other grounds to use it);
- We have unlawfully processed your personal data.

3. SALE AND SUPPLY OF ALCOHOL ACT 2012
Cable Bay Vineyards holds an ‘off license’ as defined in New Zealand’s Sale and Supply of Alcohol Act 2012 and is legally authorised to promote, sell and deliver wine via online and mail order. It is against the law to use this site to purchase liquor if you are under 18 years of age. By using this website, you affirm and represent to us that you are over the legal age required to buy and receive delivery of products containing alcohol. Our Liquor License is available to view here
4. RETURNS POLICY
Cable Bay Vineyards makes every effort to ensure that your wine and/or other purchases reach you in top condition. Unless your wine arrives, in incorrect variety or number, or is damaged, all sales are final. If you have any questions or concerns about your purchase, please contact us at info@cablebay.co.nz
5. PAYMENT AND REFUND POLICY
Cable Bay Vineyards accepts online payments and payments made over the phone via Visa, Master Card, American Express, Paypal or by bank transfer. Payments are processed at the time of your online order. If, for any reason, we are not able to fulfil your order, your account will be credited or credit card will be refunded.
Bookings made for any of our published tours or experiences are subject to availability and a full refund will be given for cancellations made more than 24 hour prior to the date of arrival. A cancellation fee (100% of the booking) applies to products cancelled within 24 hours of confirmed date of arrival. Due to circumstances beyond our control Cable Bay Vineyards Ltd. reserves the right to cancel, change times and product services as deemed necessary and clients will be advised accordingly.
6. SECURE PAYMENTS
We make every effort to protect our customers’ personal information and payment details. All online purchases are processed through a secure payment provider called PayPal. PayPal both hosts and manages the payment gateway on the Cable Bay Vineyards website. PayPal is committed to data security and uses a variety of technologies and procedures to help protect personal information from unauthorized access. PayPal uses encryption to transmit all sensitive information such as credit card numbers. They also adhere to the Payment Card Industry Security Standard (PCI DSS) governed by the PCI Security Standards Council to ensure they maintain the highest safety standards with regard to transmitting and storing sensitive card holder data. 7. WINE CLUB & HOSTED OR TICKETED EVENT CANCELLATION POLICY
In the instance that a customer would like to cancel a paid or RSVP’d booking for a Wine Club event or other ticketed event hosted by Cable Bay Vineyards, the following cancellation rules apply.
- If cancellation is within 2 or more weeks - 100% refund will be provided.
- If cancellation is within 1 week - 50% refund will be provided
- If cancellation is within 72 hours - 10% refund will be provided
- If cancellation is within 48 hours - No refund will be provided
- In the instance that a customer would like to cancel or change an event or accommodation booking at Cable Bay Vineyards or the Cable Bay Villa the following cancellation rules apply.
- If cancellation is within 2 or more weeks - 100% refund will be provided.
- If cancellation is within 1 week - 50% refund will be provided
- If cancellation is within 72 hours - 10% refund will be provided
- If cancellation is within 48 hours - No refund will be provided
8. CABLE BAY MEMBERSHIP (WINE CLUB)
The below Terms & Conditions apply to all Cable Bay Memberships upon joining. By holding a Cable Bay Membership, you agree to the following:
- 8.1 MEMBERSHIP TYPE
- 8.1.1 NEW ZEALAND MEMBERS: You have signed up to a 12 month commitment as either a CUSTOM SHIPMENT at volume and frequency of your choice or TRUST THE WINEMAKER Membership at 2x12 bottle shipments per calendar year.
- 8.1.2 Each membership will automatically renew unless you notify us of your desire to cancel your membership.
- 8.1.3 You have chosen to belong to one of two specific membership types that defines what wine is in each shipment. CUSTOM SELECTION, gives you the opportunity and responsibility to choose exactly what is sent to you from our list of available wines in 6 or 12 bottle shipments at a frequency of your choice.
- 8.1.4 TRUST THE WINEMAKER, is a mixture of seasonal wines chosen by our winemakers and comprised of a Winter 12 bottle selection sent on the 1st of May and a Summer 12 bottle selection sent on the 1st of November.
- 8.2 MEMBERSHIP DISCOUNTS
- 8.2.1 Along with Membership Type, you have chosen to receive a specific increment of wine per calendar year. The level of committed bottle count over a twelve month period defines your discount amount off the retail price; 12-23 bottles purchased over a 12 month period qualifies for a 10% discount and 24+ bottles over a 12 month period qualifies for a 20% discount, off normal retail pricing. The combination of these two variables (Membership type and committed bottle count of shipments) is how we define your membership category and is amendable up to 2 weeks prior to any shipment.
- 8.2.2 As a Cable Bay Membership holder - all wine shipments of 6+ bottles include shipping.
- 8.3 PAYMENTS AND UPCOMING SHIPMENTS
- 8.3.1 Unless affected by unforeseen logistic circumstance, we charge your credit card on file 2 weeks prior to your upcoming shipment date.
- 8.3.2 The wine is dispatched within 5 days of your credit card being processed. You will receive a notification email that your delivery had been dispatched.
- 8.3.3 You authorize Cable Bay Vineyards to charge your credit card in the amounts appropriate for your Wine Club membership, including shipping, when applicable. Shipping prices are subject to annual review in May and take effect 1st of July.
- 8.3.4 CUSTOM SELECTION members can select and amend their wine selection up to two weeks prior to their upcoming shipment date, via their online member portal on our website. If no changes are made members will be sent the standing shipment selected. Members will be sent an email 3 weeks prior to notify them of their upcoming shipment.
- 8.3.5 We review shipping prices and price ceilings annually. Any price changes will take effect 1st of July.
- 8.4 CANCELLING YOUR MEMBERSHIP
- 8.4.1 After one year, you may cancel your membership via your online members portal or by written email notice to info@cablebay.co.nz at any time up to two weeks prior to a shipment, members who send a cancellation request less than two weeks prior to a shipment will still be charged for and sent that shipment, and the cancellation will be implemented afterwards. Members are notified of all upcoming shipments 21 days in advance.
- 8.4.2 If you cancel your membership before the end of your first 12 months that is viewed as an early termination. Early terminations maybe subject to a fee of $20 or, the amount of total discount you have received up until the point of your early termination—whichever is greater. The latter amount covers discounted benefits you may have received as part of the benefits of being a member, included but not limited to savings on wine purchases, discounted event tickets, cellar door tastings and/or other members savings.
- 8.5 DELIVERY
- 8.5.1 Members are responsible for notifying Cable Bay Vineyards of any delivery address changes. Failure to notify Cable Bay Vineyards of changes in delivery addresses will result in us passing along any fees incurred. Such include, but are not limited to: the fee charged to us by the courier for failed delivery, a $20 fee for re-dispatching the wine for a second time. Members will be reminded 3 weeks prior to their delivery to update any change of address with the email of their upcoming shipment.
- 8.5.2 Members are responsible for updating their payment details via the ‘Member Home’ section of our website under the subsection titled ‘Credit Card Details.’ Members whose orders decline payment will be immediately issued an email notifying them of the declined payment from info@cablebay.co.nz. Declined orders do not constitute a membership being on-hold. Declined orders will be moved to the end of the order queue and will not be guaranteed the availability of what was initially ordered—but will be charged only for what is ultimately sent. Members will be reminded to update their payment details in the upcoming shipment email sent two weeks prior to announcing the coming shipment.
- 8.5.3 Deliveries will be attempted three times to the address that you provide. Should the three attempts fail, you acknowledge and agree to a $20 redispatch fee to cover the costs charged to us for the failed delivery as well as the cost of re-dispatching your wine a second time.
- 8.6 OTHER
- 8.6.1 By joining the Cable Bay Vineyard Membership program, you are declaring that you are the legal age of alcohol consumption in your home country and the country of delivery.
- 8.6.2 By joining the Cable Bay Vineyards Membership programme, you understand that the contact details you provide will be used to send correspondence regarding membership updates, exclusive event invitations and other information pertaining to your membership. These details will be added to the Cable Bay Vineyards database and stored securely. They will never be rented to any third parties. Email is our main and preferred method of contact.
- 8.6.3 You agree to use of any photographs taken of you or your guest at a Cable Bay Vineyards membership event for marketing purposes
- 8.7 ADDITIONAL CABLE BAY MEMBSERSHIP BENEFITS
- 8.7.1 All Cable Bay members are entitled to a maximum of 4x Complementary wine tastings per calendar year for them and up to 3x guests at the Cable Bay Cellar Door.
- 8.7.2 All Cable Bay Members are entitled to complementary use of our Cable Bay VIP dinning areas. Cable Bay Wine Cellar requires a minimum of 2 guests and can seat up to 16 for dining. The Cable Bay Motukaha Room requires a minimum of 16 and a maximum of 36 guests for dining.
- 8.7.3 All Cable Members are entitled to one VIP meet the winemaker and vineyard tour for them and up to 3x guests annually, pre booking is required.
- 8.7.4 All Cable Bay Members will be given the opportunity to pre-purchase tickets to Cable Bay events with exclusive member pricing. Limited ticket numbers may apply.
